Legislative Council assigns summer study topics

The Legislative Council met today to assign topics to be addressed by study committees this summer. This group is comprised of leadership from both political parties from the Indiana House of Representatives and Senate. Senators Lanane, Breaux and Tallian comprise the Senate Democrat members of the Legislative Council.

Each legislative session several public policy topics arise that are too complicated to be addressed by a part-time legislature that is in session for only a few months each year. These complex topics can be assigned to a summer study committee so proper consideration can be paid to the subject matter. These committees consist of legislators and may also contain experts familiar with the topic being studied. After committees have met and believe they have found a way to address the given topic, they can adopt a “preliminary draft” of a bill that will then be introduced as a bill the next legislative session of the Indiana General Assembly.

A list of the topics that have been sent to Interim Study Committees is listed below:

Interim Study Committee on Agriculture and Natural Resources:

  • To study the impact of confined animal feeding operations (CAFOs) and their proximity and impact to suburban and urban areas

Topic being considered due to legislation related to CAFOs and their ongoing controversy in Indiana

Interim Study Committee on Commerce and Economic Development:

  • Short term rentals and local restrictions on short term rentals

Topic being considered due to a provision found in HB 1133 which was sponsored by Senator Randolph

Interim Study Committee on Corrections and Criminal Code:

  • Implementation of HEA 1006 from 2014 including the availability and certification of treatment providers and treatment facilities

Topic being considered due to a provision found in HEA 1349 which was sponsored by Senator Lanane and Senator Randolph.

  • Requiring bills creating crimes or increasing penalties

Topic being considered due to a provision found in SB 58.

  • Extending support services to individuals in the criminal justice system

Topic being considered due to a provision found in HEA 1006 which was sponsored by Senator Breaux, Senator Mrvan, and Senator Randolph.

  • Serious mental illness and the death penalty

Topic being considered due to a provision found in SEA 64 which was authored by Senator Taylor.

Interim Study Committee on Courts and the Judiciary:

  • Adult protective services

Topic being considered due to a provision found in SB 345 which was authored by Senator Lanane.

  • Providing indigent defense services to persons charged with a misdemeanor and providing defense services to children who are alleged to be children in need of services

Topic being considered due to a provision found in HEA 1001 which was sponsored by Senator Tallian.

  • Civil forfeiture laws

Topic being considered due to a provision found in HEA 1123 which was sponsored by Senator Randolph.

Interim Study Committee on Education:

  • New teacher induction programs

Topic being considered due to a provision found in HEA 1449 which was sponsored

  • Topics related to the Every Student Succeeds Act (ESSA)

Topic being considered due to a provision found in SEA 407.

Interim Study Committee on Elections:

  • Policy changes to Indiana Election Law

Topic being considered due to a provision found in HB 1472.

Interim Study Committee on Energy, Utilities, and Telecommunications:

  • Self-generation of electricity by school corporations and construction of wind power devices

Topic being considered due to a provision found in SEA 309.

  • Construction of wind power devices

  • Rental rates and other fees for the attachment of communications service facilities on utility poles that are owned or controlled by electricity suppliers

Topic being considered due to a provision found in SEA 478 which was co-authored by Senator Lanane and Senator Randolph.

  • Rural broadband service in Indiana

Topic being considered due to a provision found in HB 1626.

Interim Study Committee on Environmental Affairs:

  • Adequate and affordably water utility service in areas of Indiana in which water service is inadequate or costly

Topic being considered due to a provision found in HB 1208.

Interim Study Committee on Financial Institutions and Insurance:

  • Statutory incorporation by reference of documents of the National Association of Insurance Commissioners.

Topic being considered due to a provision found in HEA 1318 which was sponsored by Senator Mrvan.

Interim Study Committee on Fiscal Policy:

  • Issues relating to eliminating the state gross retail tax on food sold through a vending machine

Topic being considered due to a provision found in HB 1013.

  • Issues related to the state gross retail tax and any innkeeper’s tax imposed and collected for transient residential housing rented or furnished for consideration.

Topic being considered due to a provision found in HB 1284.

  • Issues related to establishing a neighborhood enhancement property tax relief program to allow a county, city, or town to adopt an ordinance or resolution to provide a real property assed value deduction to longtime owner-occupants of real property located in designated areas with deteriorated, vacant, or abandoned residences and properties where homestead values are expected to rise markedly as a consequence of the refurbishing or renovating of deteriorating residences in the area or the construction of new residences in the area.

  • Tax increment financing issues and the uniform property tax assessment of nonprofit entities.

Topic being considered due to a provision in HEA 1489 sponsored by Senator Stoops.

Interim Study Committee on Government:

  • Food deserts in Indiana

Topic being considered due to a provision in HB 1643. 

Interim Study Committee on Public Health, Behavioral Health, and Human Services:

  • Shortage of health care providers in Indiana

Topic being considered due to a provision in SB 538

  • Goals, benchmarks, and plans to reduce the incidence of diabetes in Indiana

Topic being considered due to a provision in HEA 1642 which was sponsored by Senator Taylor, Senator Stoops, and Senator Randolph.

  • Potential improvements to the INSPECT program

Topic being considered due to a provision in SEA 408 co-authored by Senator Breaux, and Senator Randolph.

Interim Study Committee on Public Policy

  • Permitting requirements for alcohol retailers, including the requirements for different types of permits

Topic being considered due to a provision in SB 358 which was co-authored by Senator Randolph.

Interim Study Committee on Public Safety and Military Affairs:

  • Providing health coverage for active employees spouse and child after the death of an officer

Topic being considered due to a provision in SB 383 which was co-authored by Senator Mrvan and Senator Randolph.

Interim Study Committee on Roads and Transportation:

  • Motor vehicle inspection and maintaining program in Lake and Porter counties and whether there are alternatives to the program

Topic being considered due to a provision in HEA 1491 which was sponsored by Senator Niezgodski and Senator Randolph.

  • Whether to increase the amounts

Topic being considered due to a provision in HEA 1422 which was sponsored by Senator Niezgodski and Senator Randolph.

  • Requirements that must be met for a court to grant a petition for traffic amnesty
